      When LendingClub receives an application request, we provide applicants with important documents prior to loan consummation. These documents include the Borrower Agreement and Truth-In Lending (TIL) disclosure.The TIL disclosure includes important information about their loan, including the Annual Percentage Rate (APR) and origination fee. LendingClub requires that applicants review the TIL and accept the Borrower Agreement before submitting an application. Our records indicate ************************* reviewed the TIL and accepted the Borrower Agreement on November 28, 2018. To view the TIL disclosure and other important documentation, please have them sign into their LendingClub account online at lendingclub.com.

      LendingClub records report that ********************* personal loan originated on November 29, 2018. Contractual monthly payments were received from January 2019 to February 2020. Thereafter,the loan became delinquent.

      I am writing to express my grave concerns regarding the sharing of my nonpublic information by LENDCLUB BNK with the three major credit bureaus, as well as the furnishing of inaccurate information on my credit report. This situation has caused me significant financial and emotional distress.As a consumer, I am well aware of my rights to privacy, as outlined in 15 USC 1681, section 602. However, it has come to my attention that LENDCLUB BNK has been sharing my nonpublic information with credit bureaus without obtaining my explicit consent. This unauthorized disclosure of my information has resulted in the dissemination of inaccurate data on my credit report, adversely affecting my financial well-being.I would like to draw your attention to 15 USC 1681, Section 604 A, Section 2, which explicitly states that a consumer reporting agency cannot furnish any account information without the consumer's written instructions. It appears that LENDCLUB BNK has violated this legal requirement by furnishing inaccurate account details to the credit bureaus without my authorization.Furthermore, under 15 USC 1666 B, a creditor such as LENDCLUB BNK may not treat any payment on a credit card account under an open-end consumer credit plan as a collection/chargeoff for any purpose. It is imperative for LENDCLUB BNK to ensure compliance with federal regulations and refrain from misrepresenting account statuses on credit card accounts.Account ******************** financial and emotional distress caused by these inaccuracies on my credit report cannot be overstated. Therefore, I kindly request that LENDCLUB BNK promptly investigate this matter, rectify the inaccuracies on my credit report, and cease the unauthorized sharing of my nonpublic information with credit bureaus.Your immediate attention to this issue and swift resolution would be greatly appreciated. A member of our Fraud Investigation team contacted them directly on April 12, 2024, the team explained that the fraud claim was declined, and they provided ***************************** with information of what was needed for further fraud claim review.

      All loan applications include a members Truth in Lending (TIL) Disclosure which details the terms of the members loan. It lists their annual percentage rate (APR), which is the total yearly cost of their loan, including both the interest rate and the origination fee.  The TIL and Borrower Agreement are acknowledged by the borrower during the application process.  Borrowers may review their documents, payment history and account information at any time by signing into their online account at lendingclub.com.

      LendingClub records indicate that Jirayer Vartatanians loan originated on April 30, 2018. Contractual monthly payments were received on the loan from May 2018 through April 2019. Thereafter, the loan became delinquent. Due to non-payment, the account was charged off on September 30, 2019.

      A fraud investigation was opened on January 27, 2023 when LendingClub received a fraud claim through the credit bureaus. The investigation was closed on January 30, 2023 and the fraud claim was declined due to benefit of funds. Jirayer Vartatanian was notified of this determination by mail.

      LendingClub records indicate that ****************** filed for Chapter 7 Bankruptcy on April 28, 2023 and had their case discharged on August 14, 2023. An update has been sent to the credit bureaus to accurately report the account closed date. We recommend that Jirayer Vartatnian allow up to 60 days for the credit bureaus to report the update on their credit report.

Portion of the loan was suppose to go to my bank account ( received) portion of the loan was suppose to be paid to a creditor ( ******** ************** to pay off a previous loan. Money had to be paid to creditor not myself or personal account. Said money was never received by creditor ( ******** **************. Have called customer service numerous times with no questions answered and only told " we will follow up with you". I need the additional portion of this loan to be sent to me directly so I can pay off this previous loan that was suppose to be paid off by ************.

      As part of the application process for a balance transfer loan, LendingClub requests applicants to complete an email verification, fill out a balance transfer worksheet, and link a valid bank account for deposit of the remaining funds. The worksheet allows LendingClub to facilitate payments to the creditors of their choice. When were notified that funds from a balance transfer loan have not been received by the creditor within 7 business days, we open a dispute claim. ***************************** loan originated on March 25, 2024. On April 8, 2024, *************************** notified us one of their creditors had not been paid.

      LendingClub opened an investigation on April 8, 2024 regarding the funds to their creditor when *************************** called in and spoke with one of our phone agents. LendingClub records can confirm that as of April 11, 2024 the funds were returned and reissued to the bank account on file. We recommend that *************************** allow 5-7 business days for the funds to settle.

      LendingClub Bank reports to the credit bureaus each month;however, depending on the credit bureaus it can take up to sixty (60) days credit bureaus to report the new information received. The credit bureaus may reflect either "fully paid," or "closed," and a zero balance for fully paid loans. This varies depending on the bureau, and the language used is chosen by the bureaus. For reporting purposes, the terms are interchangeable and LendingClub is unable to alter the term being used by any bureau. Upon receipt of ***************** complaint, LendingClub has confirmed the account is being reported accurately to all bureaus as closed or fully paid with a $0 balance owed to LendingClub.
