Equal Opportunity Is the Law

It is against the law for recipients of Federal financial assistance to be discriminated against on the basis of race, color, religion, sex, national origin, age, disability, political affiliation or belief, or on the basis of participant status. Section 188 of the Workforce Innovation and Opportunity Act (WIOA) also prohibits discrimination against certain non-citizens – Participation in programs and activities receiving funds under this title shall be available to citizens and nationals of the United States, lawfully admitted permanent resident aliens, refugees, asylee, and parolees, and other immigrants authorized by the Attorney General to work in the United States.

WIOA regulations provide that covered entities must not refuse to accommodate an individual’s religious practices or beliefs unless doing so would result in “undue hardship.” See 29 C.F.R. 38.6(c)(2). Religious accommodation requests can involve, e.g., schedule changes or leave for religious observances, exemptions from or modifications to uniform, dress, or grooming requirements that conflict with religious practices, or providing a quiet area for prayer during break time.

Under the Wagner-Peyser Act regulations, no individual shall be excluded from participation in, denied the benefits of, subjected to discrimination under, or denied employment in the administration or in connection with any services or activities authorized under this Act. Additionally, no discriminatory job orders will be accepted, except where the stated requirement is a bona fide occupational qualification (BFOQ) as outlined in 20 C.F.R. 652.8(j).

What to Do If You Believe You Have Experienced Discrimination?

If you believe that you have been subjected to discrimination under a WIOA Title I-financially assisted program or activity, you may file a complaint within 180 days from the date of the alleged violation by postal mail, e-mail, or fax with either the: Equal Opportunity Officer, Office for Civil Rights (OCR), Florida Department of Commerce, 107 East Madison Street, MSC 150, Tallahassee, Florida 32399-4129; or the Director, Civil Rights Center (CRC), U.S. Department of Labor, 200 Constitution Avenue, NW, Room N-4123, Washington, DC 20210.
