New Jersey Temporary Disability Insurance (NJ TDI) offers wage replacement benefits if an employee needs time off from work. NJ TDI applies if an employee is unable to work due to pregnancy and/or childbirth or due to a non-work-related injury or illness.
Employers can participate in the state-run program, or they can self-insure or fully insure a private plan.
MetLife can provide fully insured coverage for New Jersey Temporary Disability Insurance that helps support an employer’s private plan. MetLife can also provide administrative services related to an employer’s self-insured private plan. MetLife’s insurance offering and administration of an employer’s private plan complies with the regulatory requirements of the New Jersey Temporary Disability Insurance law.
While employers are also required to provide NJ Family Leave Insurance (FLI), MetLife does not currently provide coverage for NJ FLI. For more information, please visit New Jersey's website.
MetLife’s customers are responsible for obtaining and maintaining approval of their NJ TDI private plan, voluntary plan, and/or equivalent plan with each appropriate agency and in accordance with applicable law, rules, regulations, and guidance. You should consult with your attorney about the requirements for obtaining and maintaining such approval.

To obtain a quote from MetLife, you or your broker must create a census of your eligible New Jersey workforce and send it to MetLife. This census template was developed for your convenience.
Based on the information that is provided to MetLife in your census you will be issued a quote.
Once the private plan application has been approved by the state, the state will issue a Certificate of Approval/Modification and MetLife will issue you your policy and employee notice poster.
If self-insured, MetLife will issue an Administrative Services Agreement (ASA) and employers will need to work with their own employment counsel to define their NJ TDI plan to submit to the state for approval.
Employers are responsible for registering with the state for each of their FEINs.

For fully insured coverage, MetLife will file the proof of coverage with the state and notify our customers of the approval. For self-insured plans, employers will need to submit their application to the state for approval.
If you are currently covered for TDI under the New Jersey state sponsored plan, the state will only allow a transfer out of the plan on a "future" quarterly basis (1/1, 4/1, 7/1 or 10/1). The completed DP-1 for a private plan must be in the hands of the state before the requested effective date when transferring out of the state plan.
If you currently have a fully insured plan with another insurance carrier, they must send a 60-day waiver letter to the State of New Jersey. The current carrier is required to provide 60 days' advance notice to the Department of Labor. The current carrier may request to "waive" this notice period, subject to state approval. This means that the current carrier relinquishes its right to retain liability with the employer for the legally mandated 60-day period, allowing MetLife to assume responsibility for the plan. MetLife will also need a copy of your current NJ TDI poster that shows the plan benefits and 'limitations'. The completed DP-1 for a private plan must be in the hands of the state before the requested effective date when transferring from another carrier.
For fully insured plans, MetLife will draft a DP-1 form for each separate FEIN (required by the state of NJ) for signature by an officer of your business (President, Vice President, Secretary or Treasurer). Once they are signed by an officer of your business, MetLife will send the completed DP-1 form(s) and TDI policy and poster(s), for each separate FEIN, to the state for approval of your MetLife supported private plan.
You must work with your own employment counsel to define your self-insured plan. You will need to submit your application to the state for approval. Review the state’s Self-Insured Private Plan guide for more information on self-insured private plan applications including surety bond, and other requirements.

If filing for a self-insured private plan, once you receive approval, please send your MetLife representative a copy of your state approved plan.
Employers are required to post an employee notice (poster) in a location that is easily seen by all employees working in New Jersey. It should also be provided to employees when the private plan becomes effective, at any subsequent time of hire, and within 3 business days of when the employer knows or should know that the employee may have a need for TDI benefits.
If you have a fully insured plan, you will receive an employee notice/poster from MetLife. These notices are sent annually in January for the current year.
If you have a self-insured plan, you may obtain this notice by contacting the Division of Temporary Disability and Family Leave Insurance.
When MetLife policies renew, and when state and or federal changes impact contribution rates, employers may need to consider how it impacts employee contributions, if applicable. MetLife policy renewal and state and or federal changes may not happen at the same time. If an employer collects contributions from employees, employers must adjust payroll deductions accordingly. Please review the "What's New" page on this site for details.
The state requires the administrator, or MetLife, to submit reports annually and semi-annually based on all insured NJ TDI plans across all customers.
Your MetLife policy will automatically renew on its anniversary date and any changes to premium or benefits will be communicated in advance.
If we need to make significant updates to your fully insured policy, we will refile it with the state. Once approved, we will issue updated policy documents to you for your records.
Once coverage is on file with the state, it remains in place until the coverage is terminated. Annual policy renewals and or state reapprovals are not required.
MetLife will reach out to employers to verify and or provide missing information and documentation, as needed.
